Terms and Conditions

Last updated: September 20, 2026

1. Who We Are

Eco Spas ("Eco Spas," "we," "us," or "our") is a Canadian company that manufactures, sells, and delivers HDPE hot tubs across the Prairie provinces. Our principal place of business is:

260300 Writing Creek Crescent, Balzac, Alberta, Canada

We operate showrooms serving Alberta, Saskatchewan, and Manitoba. For inquiries, see Section 17.

2. Acceptance of Terms

By visiting ecospas.ca, requesting a quote, paying a deposit, or purchasing any product or service from Eco Spas, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full.

If you are acting on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. If you do not agree to any part of these Terms, please do not use our website or services.

We may update these Terms at any time. The version in force at the time you place an order governs that transaction.

3. Products and Descriptions

All products sold by Eco Spas are one-piece HDPE (high-density polyethylene) unibody hot tubs and associated accessories and upgrades.

Product descriptions, specifications, dimensions, weights, and images on this website are provided for general information purposes only. We make every reasonable effort to ensure accuracy; however, we do not warrant that descriptions are complete, error-free, or identical to the physical product you receive. Minor variations in colour, texture, or component suppliers may occur without notice.

All specifications (jet count, water capacity, footprint, weight, electrical draw, and run-cost estimates) are approximate. Run-cost estimates are based on representative usage and Alberta average electricity rates; your actual costs will vary based on your province, utility rate, usage frequency, ambient temperature, and whether you run on 110V or 220V.

4. Pricing and Quotes

All prices displayed on this website and in quotes are in Canadian dollars (CAD) and are exclusive of applicable taxes unless expressly stated otherwise.

Website pricing is for general reference only and is subject to change at any time without notice. A written quote from Eco Spas locks in the pricing stated in that quote for 30 days from the date of issue, unless a shorter validity period is specified on the quote.

Delivery charges, if applicable, are quoted separately based on your location and will be disclosed before you confirm your order.

Applicable taxes (GST and provincial sales tax where applicable) will be added to the final invoice.

5. Orders, Deposits, and Payment

Order confirmation. An order is not binding on Eco Spas until we have accepted it in writing and received your deposit. A quote alone does not constitute acceptance.

Deposit. A non-refundable deposit is required to confirm your order and reserve production or delivery. The deposit amount will be stated on your quote. By paying the deposit, you confirm you have read and accept these Terms.

Balance payment. The outstanding balance is due in full prior to or at the time of delivery, unless a separate payment arrangement has been agreed to in writing by an authorized representative of Eco Spas.

Payment methods. We accept payment by cash, certified cheque, e-transfer, and credit card. Credit card payments may be subject to a processing fee, which will be disclosed at time of payment.

Title and risk. Title to the hot tub does not transfer to you until payment in full has been received. Risk of loss or damage transfers to you upon delivery to your property.

6. Cancellation and Changes

Cancellation by you. You may cancel your order at any time prior to delivery by notifying us in writing. However:

Order changes. Changes to an order (model, colour, options, delivery address) must be requested in writing. We will make reasonable efforts to accommodate changes but cannot guarantee that a change can be made once manufacturing has begun. Additional charges may apply.

Cancellation by Eco Spas. We reserve the right to cancel or decline any order for any reason, including inability to fulfill due to supply issues or pricing errors. If we cancel your order after receiving payment, we will refund all amounts paid in full within 10 business days.

7. Delivery

Service area. Eco Spas delivers across Alberta, Saskatchewan, and Manitoba. Delivery to other provinces or territories may be arranged at our discretion and will be subject to additional charges.

Delivery timeframes. Estimated delivery dates are provided as a courtesy and are not guaranteed. Eco Spas is not liable for delays caused by weather, road conditions, supply chain disruptions, carrier delays, or any other cause beyond our reasonable control. We will communicate with you proactively about any significant changes to your estimated delivery date.

Delivery method. Hot tubs are delivered by truck. Our delivery team will bring the unit to the edge of your prepared site. Placement of the tub on its final surface is included; craning, lifting, or any delivery requiring specialized equipment beyond standard truck delivery is not included and must be arranged and paid for separately.

Failed delivery. If delivery cannot be completed because the site is not prepared, access is blocked, or no authorized person is present to receive the unit, a redelivery fee will apply. We will contact you at least 48 hours in advance of the scheduled delivery window.

Damage on delivery. Inspect your hot tub upon delivery. Any visible damage or defects must be noted on the delivery paperwork before you sign. Failure to note damage at delivery may affect your ability to make a damage claim.

8. Site Preparation

You are solely responsible for preparing an appropriate site before delivery. Requirements include:

Eco Spas is not responsible for damage to your property (driveways, fences, landscaping, decks) that occurs during delivery when access is adequate but the path involves inherent risks. We will exercise reasonable care during delivery.

If your site is not ready on the scheduled delivery date, a redelivery fee will apply.

9. Installation and Electrical

110V operation. Standard Eco Spa models are 110V/220V convertible. To operate on 110V, simply plug into any standard 15-amp household outlet. No electrician is required for 110V operation.

220V hardwire. Hardwiring to a dedicated 220V circuit must be performed by a licensed electrician in accordance with the Canadian Electrical Code and all applicable provincial regulations. Eco Spas does not provide electrical installation services. Failure to use a licensed electrician may void your warranty and may violate local building codes.

GFCI protection. All outdoor hot tub electrical connections require appropriate GFCI (ground fault circuit interrupter) protection as required by the Canadian Electrical Code. Ensure your electrician installs the appropriate protection.

10. Warranty

What is covered. Eco Spas provides the following warranty to the original purchaser:

Full warranty terms and exclusions are available at ecospas.ca/warranty. In the event of any conflict between these Terms and the warranty page, the warranty page governs for warranty matters.

What is not covered. The warranty does not cover:

Warranty claims. To make a warranty claim, contact us in writing at elliot@ecospasalberta.com with your name, proof of purchase, description of the issue, and photos. We will respond within 5 business days.

Non-transferable. The warranty is non-transferable and applies only to the original purchaser. It is void if the tub is resold or transferred.

Consumer protection legislation. Nothing in this warranty section limits any rights you may have under the Consumer Protection Act (Alberta), Consumer Protection Act (Saskatchewan), Consumer Protection Act (Manitoba), or any other applicable consumer protection law that cannot be contracted out of.

11. Product Use and Safety

Hot tubs involve inherent risks. By using your Eco Spa product, you acknowledge and accept these risks and agree to follow all safety guidelines in your owner's manual. Without limiting the foregoing:

Eco Spas is not liable for injuries, illness, or death arising from misuse, failure to follow safety guidelines, or operation of the tub outside recommended parameters.

12. Limitation of Liability

Cap on liability. To the fullest extent permitted by applicable law, Eco Spas' total aggregate liability to you for any and all claims arising out of or related to these Terms, your purchase, or your use of our products or website shall not exceed the total amount you paid to Eco Spas for the specific product giving rise to the claim.

Exclusion of consequential damages. Eco Spas is not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages of any kind, including but not limited to: loss of income or profit; loss of enjoyment or recreational opportunity; costs of substitute accommodation; property damage not directly and solely caused by a defect in our product; or data loss. This exclusion applies whether or not Eco Spas was advised of the possibility of such damages and whether the claim arises in contract, tort, statute, or otherwise.

No exclusion of mandatory rights. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the consumer protection legislation of Alberta, Saskatchewan, or Manitoba, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

13. Website Use

You may use ecospas.ca for lawful personal or commercial purposes consistent with these Terms. You agree not to:

The parties agree that the courts of the Province of Alberta shall have exclusive jurisdiction to resolve any dispute arising under these Terms. If you are a consumer residing in Saskatchewan or Manitoba, you may also have the right to bring proceedings in your province of residence under applicable consumer protection law.
